In response to an e-mail I sent opposing the proposed Kansas Marriage Amendment
...in which discrimination against homosexuals and bisexuals would be written into the Kansas Constitution. My state representative replied thus:

Mr. Southwell,

Mr. Braman,

I appreciate the sincerity of your email. However, this Amendment is not any more prejudice than what is in statute, and I do not believe what is in statute is prejudice. This Amendment defines marriage. Without it, there is no definition, which gives the courts to much room to legislate from the bench.

For example, if I live with my sister, not a sexual relationship, should I be afforded all the rights and benefits as a married couple?

Without a definition, the courts could say yes, cutting my other siblings out of any rights they may have to my sister and her estate, as equal siblings, or even worse, her children could be left out as well. Therefore a definition of marriage is necessary.

This is the only definition that has been offered. Nothing changes today by us passing this amendment. What was law stays law. This just prevents the courts from making new law. The courts have already done this with our liquor laws, tax policy, and the school finance law.

Also, I campaigned in support of this Amendment. My opponent campaigned against this Amendment. Receiving almost 70% of the votes cast, I believe it's safe to assume the majority of the 49th district wants me to vote in favor. This is beside the nearly 200 emails from the 49th district alone, asking for its passage.

This now goes to the vote of the public. You have the final say. I am glad you voiced your opinion to me, and am very respectful of your position. Please, vote this April as well.

Oh, I did, although the Republicans won anyway.
